Terms of Use

1. Acceptance of terms

By creating an account, downloading, installing, or using KipFire, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you use KipFire on behalf of an organization, you confirm you have authority to bind that organization to these Terms.

2. Eligibility

• You must be at least 13 years old.
• You must be able to form a binding contract.
• You must not be prohibited from using the service under applicable law.
• You must provide accurate registration information.

If you are under 18, you must have a parent's or guardian's consent to use KipFire.

3. Description of service

KipFire is a mobile application that provides:

• AI-generated content tasks across multiple categories
• Video recording with the task text placed on your video as a card you can move
• Tasks in English and Spanish
• A free tier with a limit of 7 tasks per rolling 24 hours
• A Premium subscription with unlimited tasks

KipFire is currently available on iPhone and iPad. We may modify, suspend, or discontinue any part of the service at any time.

4. User accounts

4.1 Account creation

You can use KipFire as a guest, or create an account with email and password, Google, or Apple.

4.2 Account security

You are responsible for keeping your credentials confidential, for all activity under your account, and for telling us promptly about any unauthorized use.

4.3 Account deletion

You may delete your account at any time from the app menu. We may suspend or terminate your account if you violate these Terms.

5. Free tier and Premium subscriptions

5.1 Free tier

• 7 AI-generated tasks per rolling 24 hours
• Guests can use Funny and Challenges. A free account also opens Questions and Would You Rather
• Video recording with the task text on screen, saved on your device

5.2 Premium subscription

• Unlimited AI-generated tasks
• All categories, including Hot Take, Inner Me, and For You
• All free tier features
• Access to future premium features

5.3 Subscription terms

• Monthly: billed monthly, auto-renews unless cancelled.
• Annual: billed annually, auto-renews unless cancelled.
• Payment: processed through Apple In-App Purchase.
• Auto-renewal: subscriptions renew automatically unless you cancel before the renewal date.

5.4 Cancellation

Cancel any time on your iPhone or iPad: Settings → your name → Subscriptions → KipFire → Cancel Subscription. Your subscription will not renew, you keep Premium until the end of your current paid period, and no further charges are made.

5.5 Refunds

Refunds are handled by Apple, not by KipFire. You can request a refund at reportaproblem.apple.com, and Apple decides each request. If you cancel without a refund, you keep access until your paid period ends. We do not provide partial refunds for unused time.

5.6 Price changes

We may change subscription prices with 30 days' notice. Changes apply to new subscriptions and renewals, and existing subscribers will be notified before a change affects them.

6. User conduct

You agree not to:

• Use KipFire for any illegal purpose or in violation of any law
• Infringe intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the app
• Use bots or automated systems to access the service
• Resell or redistribute KipFire services
• Create fake accounts or impersonate others
• Abuse, harass, or harm others

7. Content and intellectual property

7.1 AI-generated tasks

Tasks generated by KipFire are provided for your personal use, may be similar to tasks given to other users, and should be reviewed before use. You are responsible for how you use them, including whether to attempt any challenge.

7.2 Your content

Videos and recordings you make with KipFire remain your property and are stored only on your device. You are solely responsible for your content. Because we do not store it, you grant us no rights to it.

7.3 Our intellectual property

KipFire and its trademarks, logos, and content belong to us. You may not use our trademarks without permission, copy or modify our app code or design, or create derivative works based on KipFire.

8. Disclaimer of warranties

KipFire is provided "as is" and "as available" without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free, that defects will be corrected, that it is free of harmful components, or that AI-generated tasks will be accurate or suitable for your purposes. You use KipFire at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or business opportunities. Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or expenses arising from your use of KipFire, your violation of these Terms, your content or activities, or your violation of any third-party rights.

11. Third-party services

• Firebase (Google): sign-in and app configuration
• xAI: AI task text
• RevenueCat and Apple: subscriptions and payment processing
• MongoDB: account, task, and quota storage

Your use of these services is subject to their own terms and privacy policies. We are not responsible for third-party services.

12. Privacy

Our Privacy Policy explains how we collect, use, and protect your information.

13. Changes to these terms

We may update these Terms at any time. We will post the updated Terms, update the "Last updated" date, and email you about significant changes. Continuing to use KipFire after changes means you accept the new Terms.

14. Termination

14.1 By you

You may end your account at any time with Delete Account in the app menu.

14.2 By us

We may suspend or terminate your access if you violate these Terms, if we suspect fraudulent or illegal activity, if you abuse the service, or if required by law.

14.3 Effect of termination

Your access ends immediately, your account data is deleted within 30 days, Premium subscriptions are not refunded unless required by law, and sections that should survive (such as liability and indemnification) continue to apply.

15. Governing law and disputes

15.1 Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

15.2 Dispute resolution

For any dispute, first contact us at support@kipfire.com to try to resolve it informally. If it is not resolved, it will be settled through binding arbitration, and you waive the right to participate in a class action.

16. Miscellaneous

Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and KipFire. Severability: if any provision is invalid, the rest remain in effect. No waiver: not enforcing a right is not a waiver of it. Assignment: you may not assign these Terms; we may assign ours.
